Did you know that the Illinois Legislature enacted a law that severely limits your rights?
That’s right, caps on non-economic damages in medical negligence cases were passed by the Legislature and signed into law by the Governor during the summer of 2005. The caps impose limits on recovery for pain and suffering and other non-economic damages against physicians and providers (hospitals). The most you can recover is $500,000 against a physician and $1 million against a hospital. The effect is devastating. If you do not earn a wage (for example a stay at home parent) and are injured or killed by the negligence of a doctor or hospital, you are most likely limited to the statutory cap---that’s it. For example, in the example of a nine year old child who sustains a brain injury at the hands of a negligent physician, lives on life support for six weeks and then passes away---that child’s estate is limited to $500,000 for pain and suffering and other non-economic damages. Such a result is unfair and will most likely be held unconstitutional. Please call or email your State Representative or Senator and tell them to oppose caps or limitations on recovery.
